TERMS & CONDITIONS — DYNAMO METHODS

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you”) and Dynamo Methods, LLC (“Company,” “we,” “us”). These Terms govern your access to and use of our website, software, products, programs, and services (collectively, the “Services”).

By accessing or purchasing from Dynamo Methods, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent that you meet this requirement.

2. SCOPE OF SERVICES

Dynamo Methods provides a combination of: - Business and leadership consulting - Coaching, workshops, and training programs - Software tools and digital platforms - Assessments and diagnostic tools - Physical products (including books and materials)

Specific deliverables are defined at checkout, agreement, or proposal and are considered final upon purchase.

3. USE OF SERVICES

You agree to use the Services only for lawful purposes. You may not: - Reverse engineer, copy, or exploit any part of the Services - Use the Services to transmit unlawful or harmful content - Resell, sublicense, or commercially exploit the Services without written consent

4. ACCOUNTS & SECURITY

You are responsible for maintaining the confidentiality of your account credentials. We reserve the right to suspend or terminate accounts that violate these Terms.

5. PRICING, PAYMENTS & NO REFUNDS

All prices are listed in USD unless otherwise stated

Payment is due in full at the time of purchase unless otherwise agreed in writing

You authorize us to process payments via third-party processors

ALL SALES ARE FINAL.

Due to the nature of our Services—including digital products, physical goods, and scheduled services—no refunds, cancellations, or chargebacks are permitted.

6. SERVICES & PROGRAM DELIVERY

Services (including workshops, consulting, and coaching) must be scheduled within the timeframe specified at purchase

Unused services may expire if not scheduled within the designated timeframe

The Company reserves the right to modify delivery timing due to operational needs

7. SCHEDULING, RESCHEDULING & NO-SHOWS

A minimum of 48 hours’ notice is required to reschedule any session

Missed sessions or no-shows will be forfeited

The Company may reschedule sessions due to unforeseen circumstances

8. FULFILLMENT & SHIPPING

Physical Products

Orders are shipped within 7–14 business days unless otherwise stated

Risk of loss transfers upon delivery to the carrier

Digital Products

Access is typically granted within 24–48 hours

9. LICENSE & USAGE RESTRICTIONS

Access to assessments, tools, and programs is limited to the number of licenses purchased

Licenses are non-transferable and may not be shared

Unauthorized use may result in termination without refund

10. INTELLECTUAL PROPERTY

All materials, frameworks, tools, content, and trademarks are the exclusive property of Dynamo Methods.

You may not reproduce, distribute, modify, or use our materials for commercial purposes without written permission.

11. USER CONTENT

You retain ownership of your content. You grant us a limited license to use it solely to provide Services.

12. COMMUNICATIONS

By using our Services, you consent to receive communications, including email and SMS, subject to applicable laws and opt-out rights.

13. THIRD-PARTY SERVICES

We are not responsible for third-party tools, platforms, or integrations used in connection with our Services.

14. RESULTS DISCLAIMER

We provide frameworks, tools, and guidance. Results depend on implementation, leadership execution, and organizational factors.

We do not guarantee specific outcomes.

15. WARRANTIES DISCLAIMER

All Services are provided “as is” and “as available,” without warranties of any kind.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

We are not liable for indirect or consequential damages

Total liability shall not exceed the amount paid in the past 12 months

17. INDEMNIFICATION

You agree to indemnify and hold Dynamo Methods harmless from any claims arising from your use of the Services or violation of these Terms.

18. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our control.

19. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Kansas.

Disputes will be resolved through: 1. Good-faith negotiation 2. Binding arbitration in Kansas

20. MODIFICATIONS

We may update these Terms at any time. Continued use of Services constitutes acceptance.
